20 Point Tribal Manifesto Launched by AAP Chhattisgarh (English Translation)
At 32% of total population, tribals are the dominant portion of the population in Chhattisgarh. After adding farmers and labourers, it gets to a total of 91% of Chhattisgarh's population. In terms of economic status, 91% of state’s population survive on Rs. 5,000 (or less) per month of average income. People hoped to see an improvement in their financial status when the state of Chhattisgarh was born but their expectations proved to be very far from reality. Their suffering continued as their situation worsened with time. Northern Chhattisgarh is the most naxal affected area and it is sad to see that majority of innocent tribal people across the state are also labelled as naxals, their lands are snatched away from them keeping them deprived of basic facilities. In reality, tribals are the most honest, hard working and peaceful individuals. It all began when a group of people from neighbouring states came to Chhattisgarh and started violence among locals. Tribals were exploited by outside forces and when they resisted, they were labelled as naxals. Over the years, situation has deteriorated as internal government and security forces have also started treating the tribal population as naxalites.
With excellent performance in Delhi, newly born Aam Aadmi Party will be contesting on all seats of Chhattisgarh for the 2018 assembly elections. Tribal leader Komal Hupendi is announced as the Chief Minister candidate. Agricultural scientist & farmer activist Sanket Thakur with Delhi Cabinet Minister Gopal Rai have already built AAP's organization in Chhattisgarh and now they are busy with the election campaigns. Along with state and constituency level agenda, AAP Chhattisgarh team is also preparing separate agendas for tribals and farmers. On Nov 9, 2018, the team launched its 20 point agenda dedicated to Chhattisgarh tribal population in the presence of Delhi Dy CM Manish Sisodia. This agenda focuses on tribal rights and providing them with all the basic facilities as mentioned below:
- Tribal areas will be provided with all the basic and necessary facilities
- 5th section of the Indian Constitution will be strictly implemented
- 1) All tribals will be given a title deed to an occupied property under Forest Act 2006, 2) Collective rights (format B and C) of Forest Act 2006 and modified rule in 2012 will be implemented right away to provide proprietary rights (after abolishing the Tendupatta Society) of forest cultivation to the Gramsabha, Rights to Gramsabha to issue T.P. following the guidelines adopted by Maharashtra, independence to the forest villages to decide their own revenue village, and instant implementation of habitant rights of the extremely tribal population
- Forest cultivation will also be included in the Minimum Support Price Law to fix a profitable price and any purchase below this price will be illegal
- The 1996 Finance Act will be implemented strongly. 1) By establishing a rule of law of the Finance Act 1996 and under the essence of acts 4 (A), (D), (N), Gramsabha will be made the best and most efficient in its truest form. 2) Under the Finance Act 1996, some provisions that were dissolved in Chhattisgarh in the year 1997, will be reformed. 3) Under the act 4 (O) of Finance Act 1996, law of forming self-ruling district councils in Scheduled areas of the state will be made
- Considering the 1974 circular of the Indian government, non-Scheduled tribal of Chhattisgarh will be added to the Scheduled category and the tribal who have not been included in the non-Scheduled category as yet, will be included
- Considering the "Peace" and "Efficient Governance" of the 5th list of the Constitution and under the act 4 (D) of the Finance Act, priority will be given to the traditional justice system of the tribal population to form clear laws
- Under the Para 4, act (B) of the 5th list of the Constitution, Tribal Counsel Assembly will be re-established and correct form of the law will be used in accordance with the candidate selection procedure of the multi-group representative system, and uphold the representation of individuals having knowledge of the intellectual and tribal sections of the society, and the rule of law for selecting moderator of the Tribal Counsel Assembly by the members instead of the Chief Minister will be established
- Under the essence of Para 5(2), part (B) of the 5th list, clause 275 of the act 4 (M)(v) of the Finance Act 1996, and decisions of the Honourable Supreme Court in 2018, on the recommendation of Gramsabha, arrangement for immediate administrative action will be made for solving tribal debts
- Under the tribal initiative, allocation of appropriate amount and without any diversion, and considering the clause 275 of the Constitution, arrangement for expenditure on efficient education and medical systems will be made in the Scheduled areas
- No dislocation will be allowed without permission in tribal areas. A provision of law will be introduced to control land-transfer and land-acquisition in Scheduled areas under the essence of para 5(2) of the 5th list of the Indian Constitution. In the areas where lands acquired from tribals have not been utilized for more than 5 years, those tribal families will be given back their lands
- Social and cultural rights and traditional customs of tribal will be respected and protected and museums in all the tribal blocks will be opened
- Closed hostels in all tribal blocks in the state will be made functional immediately and new hotels will be constructed for 100 male and female students at block level, 200 male and female students at tehsil level, 500 male and female students at district level, and 1000 male and female students at divisional level, which will have the facilities of library, mess, Wi-Fi
- Tribal will be given an opportunity to gain high rankings in sports by opening modern sports complex with latest archery instruction centre in all tribal blocks of the state
- In each village of all tribal blocks in the state, special funds will be arranged by the government 10 new ponds will be constructed to encourage water conservation and fish cultivation. Additionally, old ponds will be deepened and maintained as soon as possible
- Simplification of granting loans for education and employment of the unemployed tribal youth of the state will be done where the government will act like a loan guarantor similar to the Arvind Kejriwal's Delhi Government. 30% of the income/revenue earned from mineral wealth of the Scheduled Areas will be given to the Gramsabha for the development of villages
- For the development of tribals, money will be utilized under Article 275 of the Tribal Sub Plan to eradicate the basic problems of the tribal related to education, health, unemployment, malnutrition etc.
- Tribal majority areas of Chhattisgarh which are not included in Scheduled Areas, they will be analyzed and included in Scheduled Area
- In order to stop transfer of tribal land, laws in Chhattisgarh similar to the section 170 of Andhra and Telangana land-revenue act (on Scheduled Area), will be made. Laws will be made for urban areas of the Scheduled regions according to the second report of Bhooriya Committee and unconstitutional (against clause 243) works going on since 1993 will be abolished completely and implemented in accordance with previous targets
- Aam Aadmi Party will conduct a detailed analysis of the number of military forces stationed in Bastar
